Kay iSight Test Professional App – Terms and Conditions

The (Kay iSight Test Professional – iSight Pro) “APP” is provided by Kay Pictures Ltd. By using the “APP”, you are agreeing to these terms. The “APP” is intended for use by Eye Professionals or suitably qualified individuals and by using it you are confirming that you are suitably qualified and are responsible for ensuring that the correct testing procedures are employed to achieve accurate results. Please read these terms carefully before start using the “APP”.

Using Our “APP”

You may only use our “APP” as permitted by law.

Using our “APP” does not grant you ownership of any intellectual property rights in our “APP” or the content you may have access to. You may not use any copyrighted content in our “APP”. The Terms do not grant you the right to use any branding or logos used in our “APP”.

Your Content in Our “APP”

This “APP” is designed to allow you to measure visual acuity and offers the option to store results on your device.

This data is not stored elsewhere and cannot be shared or exported. To meet GDPR requirements, we recommend that when recording results, you do not use personally-identifiable data in the notes section.

When you use the “APP” we do not collect statistical data which can be traced to you.

The “APP” does not use cookies.

Software in Our “APP”

You may not copy, modify, distribute, sell, or lease any part of our “APP”, nor may you reverse engineer or attempt to extract the source code of the software.

Subscription and Payment

Our “APP” is free to download and starts with a guided demo to explain the features of both optotype and reading sections. You can then trial each section once more before restrictions apply.             A one-week free trial is part of the subscription sign up. You can purchase a monthly or yearly auto-renewing subscription which is charged through your iTunes account.

The subscription “APP” automatically renews at the end of your billing period. You can cancel at any time up to 24 hours before the subscription period ends. If you cancel, your access to the “APP” will continue until the end of the current paid subscription period.

Privacy Protection

Kay Pictures Ltd’s privacy policy explains how we treat your personal data and protect your privacy when using our “APP”. By using our “APP”, you automatically agree to our privacy policy and Kay Pictures Ltd can use such data in accordance with its privacy policy.

Modifying and Terminating Our “APP”

Kay Pictures Ltd may add or remove functionalities or features in the normal course of improving, changing, and/or updating the “APP”. We may also suspend or stop our “APP” with at least thirty (30) days’ notice prior to the complete shutdown of our “APP”.

You can choose to stop using our “APP” at will. We may also stop providing “APP” to you, or add or create new limitations to our “APP” at any time as detailed in the Terms.

Electrical safety

It is recommended that users follow all local electrical safety guidelines and safety standards for tablets computer products and use only devices regarded as safe for use in hospital and healthcare environments. The device should not be connected to a power supply during testing. Users are advised to never use wireless devices within 2 metres of sensitive medical equipment. If there is any doubt, users are advised to seek local guidance before using the device.

Cross Contamination

It is recommended that users follow all local safety guidelines for the safe use and control of cross-infection and contamination from electrical devices such as tablet computers in hospital and healthcare environments. The use of wipe-clean products for sterilising the device will reduce the risk of cross-infection or contamination.

Change of Terms

From time to time, Kay Pictures Ltd may modify existing terms and/or update these terms with additional terms that apply to the “APP”. For example, Kay Pictures Ltd may modify existing terms to reflect any mandatory changes to the law.

Limited Liability for Our “APP”

You expressly understand and agree that your use and/or purchase of “APP” are all at your sole risk. The “APP” is provided on an “as is” basis.
